In 2020, SDG Law will be saying goodbye to Darren H. Fairlie who has been selected by Judge Timothy McElduff, the newly elected Surrogate’s Court Judge of Orange County, to be his Principal Law Clerk. In this position, Darren will be researching and analyzing complex legal issues, advising the Judge, drafting decisions and orders, and conducting court conferences with attorneys, among other things. “This is a great opportunity for Darren and we are extremely proud of all his accomplishments throughout the years,” says partner, Kenneth M. Stenger.
Darren has been practicing as a litigator in the Hudson Valley region since 2006. He joined SDG Law in January of 2015 where his focus was on general civil and commercial litigation, appeals and Surrogate’s Court litigation. Through the years, Darren has handled a variety of litigated matters, such as “business divorces”, contract disputes, real property disputes, judgment enforcement proceedings and trust and estate proceedings Most recently, Darren was successful in obtaining a Temporary Restraining Order and Preliminary Injunction on behalf of a local communications company seeking to enforce a non-solicitation agreement after they terminated a sales representative for cause. He also recently won a case that many lawyers may not have pursued, which sought recovery on a million-dollar life insurance policy that had lapsed for non-payment of the premium prior to the insured father’s death. Darren analyzed the insurance contract and rarely litigated provisions of New York’s Insurance Law and fully developed the facts and theory of the case through discovery and depositions of the insurance company. Darren litigated the case in Dutchess County Supreme Court, the Appellate Division and the Court of Appeals before obtaining a judgment for the full value of the policy, plus several years of interest, against the insurance company, which was fully collected.
