When you are arrested, the process usually begins with a judge issuing a warrant for your arrest. A police officer will then execute the warrant and arrests the person. The police officer will then take him or her into custody. The police should read the person arrested his Miranda rights at this time. He/she should be taken to a judge or magistrate within 24 hours of the arrest. In some cases, like with a DWI or DUI, you may be arrested on the spot and then the process continues as the above states.
